NCAA and new laws?

  • So...Colorado and Washington - I think - have voted to legalize recreational use of marijuana. My questions now:

    What does the NCAA do? Will they be forced to change their drug policy? Is there any chance this could effect recruiting in any way? Would you be able to drug test a 21 year old USC player for marijuana after playing a game at Colorado?

    How about professional sports: Does the NFL, NHL, MLB, NBA, etc... change its policy? Would this give teams in these states a competive advantage in landing FA - think a Ricky Williams type of player?

    I know it is still illegal under Federal law. Therefore, I would expects several lawsuits before it's all said and done and any real changes will be implemented.

  • They do not have to do anything. They can set rules regardless of state law. Example it is against NCAA rules to sell memorabilia but allowed under the law. The NCAA is considered a voluntary organization so their members can set rules regardless of state laws. In addition the NCAA does not require schools to ban certain drugs or even have a drug policy at all. The only rule is if you have a drug policy then the school has to abide by it.
    Also it will not effect the pro sports leagues either. Those drug testing rules are established by the CBA. A lot of NFL players are being suspended for using Adderall even though they have a prescription it is against the leagues drug policy.

    This is exactly correct. New laws have nothing whatsoever to do with what an organization like the NCAA and it's member schools set for rules.

    It's always been legal to flunk out of college, but you've never been able to play football at an NCAA school if you do.

    Or it would look like Oregon looks like now. Is it not legal there as well?
