OT: Simple Possession Citation

  • A couple buddies of mine and myself got simple possession of marijuana citations in Williamson County and were wondering the best way to handle the situation. Is a lawyer a necessity, what's the most likely punishment, would pretrial diversion be a good idea for this case? No previous criminal record and spent the whole summer biking across the country raising money and awareness for peoples with disabilities.

    If anyone has any previous experience with this or are involved in law etc, I'd appreciate the help.

    Flame away: drugs are bad blah blah I know. Just need some advice.

  • Move out here to Colorado...where we understand that pot is less dangerous than alcohol...

  • no judging from my end man haha. Drinking and smoking cigarettes do much more harm to your body. I have never been cited or anything, but this happened to a couple of my buddies as well. All they did was appear in front of a judge, pay some court fees, and that was about it. Do you go to college anywhere? If so, judicial affairs could get involved, but it would be a slap on the wrist at the very most. In other words, don't spend your money on a lawyer.

  • I'm. a LEO and about the only thing you really can do is just pay your fines and go to court say your guilty pretty much you have evidence against you and would waste time and money and probably get a worse punishment

  • Definitely get a lawyer. I had to deal with this last year with my son. (Who is also in college) There are some things the lawyer can walk you though that will allow you to avoid using diversion. (Once you use it, you lose it) My son completed 20 hours of community service, paid a fine, and went for a drug abuse assessment. By doing this he did not use diversion. It also did not go on his record.

  • Depends on where you are, here in Ga. My cousin got a fine and I think 6-12 months probation.

    I don't know if I would get a lawyer or not, but your penalty will be probation for at least a year. If anything, don't plead guilty & you need to plead no contest if you decide not to get a lawyer. Pleading guilty is the worst advice a lawyer can give, so if they tell you that then find one who says otherwise.

    I would at least see about getting a pre trial diversion since it is your 1st charge. If you do decide to get a lawyer, you're looking at about $1,000 a least with their fees, probation fines, court costs, etc. on top of that. My best advice if you're going to get a lawyer is to get Pre Paid Legal. It's a great service almost like legal insurance & they will give you free consultation along with a list of the best lawyers in that county for that specific charge. Then, if you decide to use that lawyer they will give you a 25% discount on their fee. Either way, you want to get a pre trial diversion so it will be expunged off your record after you have served you probation term. If you need anything else, just private message me...

    Lawyer up! A good attorney WILL keep the charge off of your record and you do not want a drug charge on your record.

    This. As long as it was simple possession & no distribution charge, take the charge and should come out with some fines and probation.

    i agree when it comes to dealing with any drug charge simple or not ide have a lawyer and either way have this off your record...at the end of the day just want your money.

    spot on rockytop..jetervol knows the judge this the route to take then...if we need any advice on something its good know jetervol is a lawyer...
