Question for Wes

  • You stated on Twitter that this ownership stake thing apparently violates NCAA regulations. Is there any way around those guidelines?

  • What if the ownership was put under his other half's name? Is it still against the NCAA rules?

  • In theory, I would think Haslam could donate that part of the Browns to UT, who could then give it to Gruden.

But I'd be really careful about citing this as some kind of fact. The story didn't even properly identify the Haslam who actually bought the Browns.

Or could it be written as a $10 million signing bonus that Gruden then turns around and invests in the Browns. If they want it to happen they will find a loophole.

I think Wes is hitting the point that any compensation has to come from the University, not from boosters or other outside sources. Someone mentioned Pat Summit and the WNBA in another thread, but that was a consultancy contract between her and that team and was completely unrelated to her compensation package from UT. I actually think that this possibility may be unchartered territory for the NCAA...

The bigger issue with this arrangement would be the NFL. They have very strict ownership rules. Only individuals and families can hold ownership stakes - no corporate ownership of any kind. The Packers are grandfathered in. They would never approve UT holding a stake and therefore would be unable to transfer to Gruden. They could agree to sell him a piece of the team but I find it hard to believe the NCAA would allow to happen.

Wes and I essentially said the same thing. The only difference is in his example he donates a share of the Browns to UT. As opposed to my example where he donates cash to UT and let's Gruden invest in the Browns on his own. I was in the process of typing my reply when his posted so I didn't see it until I had already submitted my post.

Probably but the NFL would never allow that to happen. I am sure the IRS would have an issue with it as well.
